New forms of sexual violence: gift giving, stealthing and sextortion

Abstract

Contemporary times have brought with them new forms of sexual violence. Although various sexual crimes are regulated and punished by law, new means of achieving such crimes make it difficult to classify the conduct as traditional criminal offenses. This research aims to expose three emerging sexual practices that deserve specific legal support: gift giving, stealthing, and sextortion. Considering that the legal response is adaptable, it is also necessary to analyze the repercussions of these acts of violence and the extent of the damage caused, especially to the physical and mental health of victims. Objectives: To reveal new illicit sexual practices, the possible impacts of these practices on the health of victims, and the responses that Brazilian law has or needs to develop. Methodology: Narrative review of the doctrine and current standards. Results: There is a large legislative gap regarding new forms of violence, and there is a real delay in constructing legal support and legal remedies capable of protecting the physical and psychological integrity of victims of these new sexual practices. Conclusions: Despite the absence of specific rules, it seems possible to include new illicit sexual practices in the current rules on sexual crimes.
